What is the main difference between the packages?
Executive is a "DIY" model where we draft the argument, but you submit it. SuccessPay and Pro are full-service; we handle the filing, deadlines, and case management.
How does "SuccessPay" work?
You pay a lower fee to start. You only pay the final $799 "success fee" if and when the USPTO approves your mark for publication. If we don't win, you don't pay the final fee.
Are gov fees included?
No. Our packages cover professional analysis and legal drafting. Mandatory government filing fees charged by the USPTO remain your responsibility.
Are you a law firm?

What is a §2(d) Likelihood of Confusion refusal?
This is a USPTO refusal claiming your mark is too similar to an existing registered mark. It is the most complex refusal type, requiring a multi-factor legal argument (du Pont factors) to overcome.

How long does the process take?

Do you guarantee approval?
No ethical service can guarantee a USPTO outcome. However, our SuccessPay model guarantees our incentives are aligned—we don't earn our full fee unless you win.
What happens if my mark is abandoned?
If your mark is already abandoned, we can file a Petition to Revive in some cases, but this is a separate process. Our packages are for active Office Actions.
Why shouldn't I just use a generic template?
Generic templates fail because §2(d) refusals are fact-specific. Examiners look for case law relevant to your specific industry and mark structure. Templates do not provide this.
Can I upgrade from Executive to SuccessPay later?
Generally, no. The SuccessPay model requires us to manage the case from the start to ensure the strategy is executed perfectly. Executive is for clients who want to manage their own filing.
What if I have multiple refusals in one Office Action?
Our packages cover the entire Office Action response, including §2(d) and other minor procedural refusals (like disclaimers) contained in the same letter.
Do I need to speak with an attorney?
If you require legal advice, you should consult an attorney. We provide expert administrative drafting and strategy based on USPTO procedure, not legal counsel.
What evidence do you need from me?
We will ask for evidence of how you use your mark, such as sales figures, marketing channels, and customer overlap info. We handle the formatting and submission.
What is a "Request for Reconsideration"?
If the examiner maintains the refusal after our first response, we can file a Request for Reconsideration. This is included in the Pro package and available in others.
Does Mind Marker handle the filing or do I?
In SuccessPay and Pro, we handle the electronic filing for you. In Executive, we send you the drafted PDF/Word doc, and you upload it to the USPTO.

What is the deadline to respond?
